Terms of Service

1. The service

Namup is a personal financial-clarity tool: it helps you understand your situation, track your goals, and read your numbers. You make every decision yourself. The service is operated by Namup, LLC, a Delaware (United States) company, address in section 17.

2. Namup is not a bank

Namup does not hold, transmit, or manage your money, and is neither a payment institution nor an e-money institution. The app shows you the calculation; you make the movements real with your bank.

3. No financial advice

Namup provides no financial or investment advice and no regulated financial service. Its insights are informational and educational only. For personalised advice, consult a licensed professional.

4. Eligibility

You must be at least 18 (or the age of majority in your country) and have the legal capacity to enter into a contract. This 18 threshold is about the legal capacity to enter into a contract. The Privacy Policy states a second threshold, 16, which is the age of independent consent to the processing of personal data (being able to agree to that processing without a parent), set by Article 8 of the GDPR (the European regulation that governs the use of personal data). The two thresholds settle two different questions and both apply: using the service requires 18, and Namup does not knowingly collect data from anyone under 16.

5. Your account

You provide a valid email; sign-in is with Google or with a sign-in link sent to your email, no password. You are responsible for activity on your account and for keeping access to your email inbox secure. One account per person.

6. Subscription and billing

Paid subscriptions auto-renew until cancelled; you can cancel anytime, effective at period end. The merchant of record for the subscription, meaning the party that sells it to you, is Stripe, which makes the sale under the name Link; the charge appears on your statement prefixed with LINK.COM*, and the receipt records the sale as made through Link. Your Link account lets you view the order, cancel the subscription and change the payment method. Namup, LLC operates the service and remains your contact for the product itself. In the countries where Stripe takes on the VAT (value-added tax), among them every country of the European Union, Stripe takes the payment, calculates the applicable VAT, collects it and remits it to the tax authorities. In the other countries, the VAT remains the responsibility of Namup, LLC, and the invoice then carries the name and tax details of Namup, LLC. EU consumers have a 14-day right of withdrawal for distance contracts, and Namup does not ask you to waive it in order to start the service immediately. Any price increase is notified at least 30 days in advance. The Refund Policy sets the times, the cases refunded, and the steps to follow.

7. Your data

Your financial data belongs to you and stays on your device by default; we never read it. You enable the cloud or AI only if you choose to (each optional and revocable); even the cloud backup is encrypted and unreadable by us. Your account holds only your identity (email, subscription), not your money. You can export your data (CSV/JSON) and delete your account anytime. We never sell your data.

8. Artificial intelligence

AI (Claude Haiku, via a secure proxy) is used only to phrase insights better, and only if you turn on the AI assistant. It computes none of the figures you see. Most calls send only a derived, aggregated context (no exact amounts). Three features are the exception, and each has a switch of its own, off to begin with. If you enable “Read your monthly text,” the sentence you write is sent to the AI to read your figures, and your contact details (email, IBAN, card, phone) are stripped on your device before sending. If you enable smart search in your vault, the document you point at is sent as it is, to be read: what a document holds cannot be masked without making it unreadable, which is why this feature has its own switch, separate from the AI one. If you show the “Decide” tool a photo, it leaves with the capture data, location included, stripped on your device; what the picture shows goes as it is. In all three cases this data is never used to train the AI and is kept only briefly, solely to prevent abuse. You can turn it all off at any time.

9. Acceptable use

You agree not to use the service unlawfully, reverse-engineer it, introduce malware, or circumvent its limits or resell it.

10. Intellectual property

The app, its design, code, and trademarks belong to Namup. These terms grant you only a limited licence to use the service. Your data remains yours; you grant us a limited licence to process it to provide the service.

11. Sub-processors

The service relies on sub-processors, meaning companies that handle data for us and on our instructions. The full list, and what each one receives, sits in section 5 of the Privacy Policy, and no sub-processor is added until that section names it. Namup is not responsible for their availability or practices, which are subject to their own terms.

12. Availability and changes to the service

The service is provided “as is” with no guarantee of uninterrupted availability. We can change or withdraw the service. We give at least 30 days' notice by email before any change that removes a feature you use or raises the price.

13. Estimates, not guarantees

Amounts are estimates built from what you declare, only as accurate as your declarations. Namup warrants no accuracy, completeness, or suitability for your situation.

14. Limitation of liability

To the extent permitted by law, Namup is not liable for financial decisions you make, data loss tied to your device, or the sub-processors named in section 5 of the Privacy Policy. Your mandatory EU consumer rights remain intact.

15. Governing law & disputes

These terms are governed by the law of the State of Delaware (United States), where Namup, LLC is registered. For EU consumers, the mandatory rules of your country of residence apply, and this clause does not displace them. Any complaint goes first to hello@namup.net.

16. Zakat, Tathir, and participatory finance

The app's calculators and models, namely the Zakat calculator, the Tathir calculator and the Mourabaha financing calculator, are provided purely for illustrative and educational purposes, based on the public data of the referential (standard or school) you select. They constitute neither a religious opinion (fatwa) nor a certification of compliance. For any decision engaging your religious responsibility, you must consult the competent religious authority of the chosen referential. This section also applies to any calculator added to the app after the date of these terms.
